GiveCircle Donation Terms

1. Introduction

These Terms and Conditions (“Terms”) are an agreement between anyone making a charitable donation (“Donation”) via the “Website”. The “Website” refers to any web page hosted on the following domains, including any subdomains: givecircle.com, ndacs-givecircle.com and donate-givecircle.com. We may add additional domains to this list at any time.

These Terms, together with the GiveCircle’s Terms of Use, apply to anyone making a Donation to a charity using the Website. By making a donation via the Website, you agree to be bound by these Terms, GiveCircle’s Terms of Use and Privacy Policy.

Any Donations made via the Website are processed by GiveCircle Ltd (‘GiveCircle”, “we”, “us”) registered in England and Wales, company number 04395570. Our registered address is The Stables, St Georges Terrace, Newcastle, NE2 2HB.

You should retain a copy of these Terms for your reference. If you do not agree to comply with these Terms then you should not make a Donation via the Website.

We may modify any of these Terms at any time and at our sole discretion for any reason. We will post the revised agreement on this website.

These Terms do not apply to the GiveCircle Lottery, the rules for which can be found here.

These Terms are subject to change from time to time.

2. Active Donations

GiveCircle allows you to make a Donation to a charity of your choice.

When you successfully complete a form on the Website to make a Donation to a charity, you set up a recurring donation to that charity, this is an “Active Donation”.

When setting up an Active Donation, you will need to provide a valid mobile number registered in the United Kingdom. We may also request some additional information to set up your Donation.

Active Donations can be made using the following payment methods, this is your choice. From time to time, we may contact you to ask if you would like to change your donation to an alternative payment method from this list:

  • Carrier billing – taken from your mobile phone credit or added to your mobile phone bill
  • Standing order – an instruction by you to your bank to make a regular fixed payment
  • Direct Debit – an arrangement made with your bank which allows us to take payment of your donation on an agreed date of the month
  • Any other payment method which we choose to utilise at any time

When setting up an Active Donation, it is your responsibility to provide the correct information. We can take no responsibility for any charges if an Active Donation is set up incorrectly, or fails, due to incorrect information being provided.

We only accept Donations in pounds sterling – Donations made in other currencies will be converted by your payment card provider in accordance with your agreement with them. Any bank fees generated by this conversion are outside of our control and do not affect the value of your donation.

Payment is taken by GiveCircle. Our name may be stated on your bank statement or mobile phone bill, rather than that of the charity. The Donation is paid by us to the charity, less any fees, in accordance with section 5.

3. Inactive Donations

Active Donations are set up on a recurring basis and will continue to be charged until one of the following circumstances arises:

  • Your Donation is processed via carrier billing or Direct Debit and you inform us you would like to stop your Donation by opting out via help.givecircle.com, phoning our helpline on 0333 4444 111 or emailing [email protected].
  • Your Donation is processed via standing order and you inform your bank that you would like to stop your regular payment to us.
  • Your Donation is processed using another payment method and you follow the instructions given at help.givecircle.com
  • We choose to stop your Donation for any reason.

Once an Active Donation has been stopped, it becomes an “Inactive Donation”. An Inactive Donation will no longer be charged.

If you have an Active Donation and you wish to make it an Inactive Donation, it is your responsibility to do so. If you encounter any difficulties in doing so, please phone our helpline on 0333 4444 111 or email [email protected].

4. Gift Aid

If you choose to add Gift Aid to your Donation, then Gift Aid can be claimed by the charity on your behalf.

You must only add Gift Aid if you are eligible to do so, and it is your responsibility to answer the Gift Aid eligibility questions correctly and to provide the correct contact details. Gift Aid can only be paid to the charity if they are approved by HMRC to receive Gift Aid. The approval of Gift Aid is at the sole discretion of HMRC and we can take no responsibility for the decisions they make.

If you are unsure if you are eligible to add Gift Aid to your donation, you should seek advice from HMRC or your own adviser(s); we cannot provide financial or tax advice.

If you have an Active Donation and have chosen to add Gift Aid, and you subsequently become no longer eligible to add Gift Aid, it is your responsibility to stop your Active Donation and contact the charity to inform them.

5. Charities

Any charity collecting Donations on the Website is registered with the Charity Commission for England and Wales and/or the Office of the Scottish Charity Regulator.

You may choose to support any charity we list. Some charities may have similar names, descriptions or logos – it is your responsibility to select the charity you intend to select.

You may choose to support multiple charities at any given time.

It is only possible to move an Active Donation to a different charity in exceptional circumstances. If you wish to change the charity you support, you should stop your Active Donation and start a new one with the charity you wish to support.

In cases where Donations can no longer be made to a particular charity, your Active Donation may be moved to another charity at our discretion. Where possible, you will be notified of any such change ahead of time, or as soon as possible afterwards.

All Donations are paid by us to charities in full, minus a Donation Fee of 20%. The Donation Fee covers the cost of processing donations, running marketing initiatives and developing technology to help charities find new supporters.

GiveCircle does not charge charities any upfront costs, to remove any financial risk from the charity. All charities listed on the Website have agreed that our fee model provides a cost-effective way to grow support.

Each charity reserves the right to utilise the funds raised for any purpose as they see fit. The charity’s decision regarding use of funds is final.
